By using IntentPost (“IntentPost,” “we,” “us,” or “our”), you agree to the following terms, policies, and disclaimers.

1. Terms of Service

Eligibility

You must be at least 18 years old and authorized to act on behalf of your organization. By using IntentPost, you confirm these terms are binding.

Accounts and Security

You are responsible for maintaining the confidentiality of your credentials and for all activity within your account. Notify us immediately of any unauthorized use at contact@intentpost.ai.

Acceptable Use

You agree not to:

• Use the Service to send unlawful, harassing, or misleading content.
• Upload purchased or non–opt-in contact lists.
• Violate any laws, including CAN-SPAM, TCPA, GDPR, or CCPA.
• Reverse-engineer, resell, or compete with IntentPost using our platform or data.
• Interfere with our systems, APIs, or other users.

Intellectual Property

All software, designs, and content within the Service belong to Sidequest Inc. Using IntentPost does not grant you ownership or licensing rights.

Termination

We may suspend or terminate your account for non-payment, policy violations, or misuse. You may cancel anytime, but fees are non-refundable.

Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee specific results, uninterrupted uptime, or perfect accuracy.

Limitation of Liability

To the fullest extent permitted by law, Sidequest Inc. shall not be liable for indirect, incidental, or consequential damages.
Our total liability shall not exceed the fees paid to IntentPost in the three (3) months preceding any claim.

2. Privacy Policy

Information We Collect

We collect:

• Account details (name, email, company, billing info)
• Uploaded lead and campaign data (names, emails, phone numbers, LinkedIn, addresses)
• Intent signals (page views, clicks, form fills, CRM events)
• Usage data through cookies and analytics tools (Google Analytics, Microsoft Clarity, and others)

How We Use Information

We use data to:

• Operate and improve the platform
• Execute and personalize campaigns
• Communicate with customers
• Comply with legal obligations

Sharing and Processors

We only share information with trusted, SOC 2 and HIPAA–compliant partners for hosting, fulfillment, analytics, and data enrichment.
We never sell personal data.

Data Retention and Deletion

We retain data indefinitely unless deletion is requested.
We will delete or export assets uniquely owned by the customer (like logos or uploaded files), but anonymized or model-training data may remain.

Security

We use industry-standard security, encryption, and access controls through compliant partners. While we maintain best practices, no system is fully secure.

Your Rights

You may request access, correction, or deletion of your information by emailing privacy@intentpost.ai.

3. Data Processing and Security

Sidequest Inc. acts as a data processor for customer data, while customers serve as the data controllers.
We work exclusively with vetted, compliant subprocessors and notify customers of any data breach that materially affects their stored data.

4. Acceptable Use Policy

By using IntentPost, you agree not to:

• Upload or use non–opt-in or illegally obtained contact data
• Send spam or deceptive content
• Attempt to bypass rate limits or misuse APIs
• Engage in illegal, abusive, or unethical activity using the Service

Violating these terms may result in account suspension or termination.

5. Payments, Refunds, and Billing

Billing

We use third-party payment processors such as Stripe to process payments via credit card, debit card, ACH, or wire transfer.
Subscriptions renew automatically unless canceled before the next billing date.

Fees and Setup

Some plans include setup or onboarding fees; others may have minimum commitment terms.

Refund Policy

All payments are non-refundable.
At our discretion, we may grant credits based on review. Credits are not guaranteed and cannot be converted into cash.

Late Payments

Past-due invoices may result in service suspension and legal recovery with interest charged at the maximum rate permitted by law.

6. Fulfillment, Attribution, and Performance Disclaimers

• We use both in-house and third-party fulfillment partners for printing, shipping, and delivery.
• We are not responsible for incorrect addresses, carrier delays, or lost shipments.
• Delivery timelines are estimates only.
• We track attribution using QR codes, promo links, and unique identifiers.
• Performance metrics (meetings booked, conversions, etc.) are estimates only and not guaranteed.
• Credits may be issued at our discretion for significant service issues, but refunds are not provided.

7. API and Integrations

• API usage and rate limits are defined by your plan.
• Reselling or white-labeling our API requires written consent.
• Integrations (e.g., HubSpot, Salesforce, Clay) are provided “as is.”
• IntentPost is not responsible for downtime, data corruption, or functionality loss caused by third-party systems.

8. Intellectual Property and Content Rights

• All content, copy, and creative assets generated within IntentPost belong to Sidequest Inc.
• Customers may request permission to export or reuse generated content after cancellation.
• Uploaded assets (logos, brand visuals, etc.) remain the customer’s property.
• Reverse engineering, copying, or scraping the platform is prohibited.
• DMCA procedures apply for copyright-related issues.

9. Marketing, Testimonials, and Beta Features

• IntentPost is currently in beta and provided “as is” with limited support.
• Testimonials and case studies reflect individual results, which vary by client.
• IntentPost may use client names or logos publicly for marketing or case studies unless a written removal request is submitted to contact@intentpost.ai.
• Customers do not need to grant advance permission for logo use, but removal requests will always be honored.

10. Legal Disclaimers

• No Guarantee: We make no guarantees about performance, conversions, or outcomes.
• Third-Party Services: We are not responsible for any errors or issues arising from integrated tools, APIs, or vendors.
• Governing Law: These Terms are governed by the laws of the State of Delaware, USA.
• Dispute Resolution: Disputes shall first go to binding arbitration in Delaware, but Sidequest Inc. reserves the right to pursue litigation at its sole discretion.

11. Cookies and Tracking

IntentPost uses cookies and analytics tools to understand website traffic and improve user experience.
We operate solely within the United States and do not display cookie consent banners.
You may disable cookies in your browser settings, but this may limit functionality.
